Welcome to Fidro. By accessing or using our fraud detection and risk analysis API services ("Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing, browsing, or using Fidro's website, API, or services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Fidro provides an advanced fraud detection and risk analysis API that offers:

  • Email validation and disposable email detection
  • IP address analysis and geolocation services
  • Risk scoring algorithms for signups and transactions
  • Stripe transaction chargeback prevention
  • Custom blocklist management
  • Real-time fraud detection and prevention

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use our Service. By using the Service, you represent and warrant that you meet these requirements.

4. Account Registration

4.1 Account Creation

To use the Service, you must:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your API keys and account credentials
  • Notifying us immediately of any unauthorized access or security breach
  • Any actions taken using your account, whether authorized or not

5. API Usage and Restrictions

5.1 Permitted Use

You may use our API to:

  • Integrate fraud detection into your applications and services
  • Validate user signups, transactions, and other activities
  • Implement custom fraud prevention rules via blocklists
  • Access historical data and analytics for your API requests

5.2 Prohibited Uses

You may not:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to reverse engineer, decompile, or discover the source code of the Service
  • Use the Service to harass, abuse, or harm another person or entity
  • Interfere with or disrupt the Service or servers/networks connected to the Service
  • Resell, redistribute, or sublicense access to the Service without written permission
  • Circumvent any rate limiting or access controls
  • Use the Service to process personal data in violation of applicable privacy laws
  • Generate fake or fraudulent API requests to inflate usage statistics
  • Share API keys with unauthorized third parties

5.3 Rate Limits

Your account is subject to rate limits based on your subscription plan. Exceeding these limits may result in temporary throttling or service interruption. Enterprise plans may negotiate custom rate limits.

6. Data Privacy and Security

6.1 Data Collection

When you use our Service, we may process:

  • Email addresses, IP addresses, and other data you submit for validation
  • Metadata about API requests (timestamps, response codes, etc.)
  • Account information and billing details

6.2 Data Usage

We use submitted data solely to:

  • Provide the fraud detection and risk analysis services
  • Improve our algorithms and detection capabilities
  • Comply with legal obligations
  • Generate anonymized statistics and insights

6.3 Data Retention

  • API request data is retained for 90 days by default
  • Account data is retained for the duration of your account plus 30 days after termination
  • Billing records are retained as required by applicable law

6.4 Your Responsibilities

You are responsible for:

  • Ensuring you have the legal right to submit data to our Service
  • Complying with all applicable privacy laws (GDPR, CCPA, etc.)
  • Obtaining necessary consents from end users
  • Providing accurate privacy disclosures to your users

7. Subscription Plans and Billing

7.1 Pricing

Current pricing is available at fidro.io/pricing. We reserve the right to change pricing with 30 days' notice to existing customers.

7.2 Payment

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as expressly stated in these Terms
  • You authorize us to charge your payment method for all applicable fees
  • Failed payments may result in service suspension or termination

7.3 Free Tier

Our free tier includes:

  • Limited API requests per month
  • Access to core features
  • Community support

Free tier accounts may be subject to additional limitations and are provided "as-is" without service level guarantees.

7.4 Upgrades and Downgrades

  • You may upgrade or downgrade your plan at any time
  • Upgrades take effect immediately
  • Downgrades take effect at the start of the next billing cycle
  • No refunds are provided for downgrades

8. Service Level and Support

8.1 Availability

We strive to maintain 99.9% uptime for our API services, excluding scheduled maintenance. However, we do not guarantee uninterrupted access and are not liable for any downtime.

8.2 Support

Support levels vary by subscription plan:

  • Free Tier: Community support via documentation
  • Paid Plans: Email support with response times based on plan level
  • Enterprise: Dedicated support with custom SLAs

8.3 Maintenance

We may perform scheduled maintenance with advance notice. Emergency maintenance may be performed without notice.

9. Intellectual Property

9.1 Our IP

The Service, including all software, algorithms, designs, trademarks, and content, is owned by Fidro and protected by intellectual property laws. These Terms do not grant you any ownership rights to our intellectual property.

9.2 Your Data

You retain all rights to the data you submit to our Service. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.

9.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, we may use them without any obligation to you.

10. Confidentiality

10.1 Confidential Information

"Confidential Information" includes:

  • API keys and authentication credentials
  • Proprietary algorithms and methodologies
  • Non-public pricing and features
  • Any information marked as confidential

10.2 Obligations

You agree to:

  • Keep Confidential Information secret
  • Use it only for authorized purposes
  • Protect it with the same care you use for your own confidential information

11. Warranties and Disclaimers

11.1 Service "As-Is"

THE SERVICE IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 No Guarantee of Accuracy

While we strive for accuracy, we do not warrant that:

  • The Service will be error-free or uninterrupted
  • Risk scores and fraud detection results are 100% accurate
  • All fraudulent activity will be detected
  • Legitimate users will never be flagged

11.3 Your Responsibility

YOU ARE SOLELY RESPONSIBLE FOR:

  • Decisions made based on our risk scores and recommendations
  • Implementing appropriate additional security measures
  • Complying with applicable laws and regulations
  • Your own data backup and security practices

12. Limitation of Liability

12.1 Damages Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIDRO'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12.2 Excluded Damages

IN NO EVENT SHALL FIDRO BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Lost profits, data, or business opportunities
  • Damages arising from your use or inability to use the Service
  • Third-party claims or actions

12.3 Basis of Bargain

The limitations in this section apply even if we've been advised of the possibility of such damages and form an essential basis of the bargain between us.

13. Indemnification

You agree to indemnify, defend, and hold harmless Fidro and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of applicable laws or regulations
  • Content or data you submit to the Service

14. Term and Termination

14.1 Term

These Terms remain in effect while you use the Service.

14.2 Termination by You

You may terminate your account at any time through the dashboard or by contacting support. Termination does not entitle you to a refund.

14.3 Termination by Us

We may suspend or terminate your account if:

  • You breach these Terms
  • Your account is inactive for an extended period
  • We discontinue the Service
  • Required by law or legal process

14.4 Effect of Termination

Upon termination:

  • Your right to use the Service immediately ceases
  • You must cease all use of the API and delete any API keys
  • We may delete your account data after 30 days
  • Provisions that should survive termination will remain in effect

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitute acceptance of the modified Terms.

16. Changes to Service

We may modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Fidro is registered, without regard to conflict of law principles.

17.2 Dispute Resolution

Before filing a lawsuit, you agree to attempt to resolve disputes informally by contacting us at legal@fidro.io.

17.3 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court.

17.4 Class Action Waiver

You agree to bring claims only in your individual capacity and not as part of any class action or representative proceeding.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fidro regarding the Service.

18.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

18.3 Waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

18.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

18.5 Force Majeure

We are not liable for any failure or delay due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

18.6 Export Control

You may not use or export the Service in violation of applicable export control laws and regulations.

18.7 No Agency

Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Fidro.

19. API-Specific Terms

19.1 API Keys

  • API keys are unique to your account and must be kept confidential
  • Test mode keys are for development purposes only
  • Live mode keys process real data and incur charges
  • We may revoke API keys if we detect abuse or suspicious activity

19.2 Test Mode

  • Test mode provides predictable results for development
  • Test mode data does not affect production statistics
  • Test mode requests may have different rate limits
  • Test mode is not intended for production use

19.3 Webhooks

If you use webhooks:

  • You are responsible for maintaining webhook endpoints
  • We retry failed webhook deliveries up to 3 times
  • Webhook data should be validated using provided signatures
  • We may disable webhooks that consistently fail
